EPA Finalizes TSCA Rule for PFAS and Toxic Chemicals Review Process
On December 4, EPA finalized amendments to the Toxic Substances Control Act (TSCA) regulations for reviewing new chemicals. This final rule ensures that new PFAS and persistent, bioaccumulative and toxic (PBT) chemicals with potential for human exposure are subject to the full safety review process prior to manufacture. The rule specifies that EPA must make one of five statutory determinations for each premanufacture, significant new use, and microbial commercial activity notice for these chemicals before manufacturing or processing can commence. The rule amends the regulations to list the actions required in association with each of those determinations and improves efficiency in the new chemicals review process.
