EPA Seeks Comments on TSCA Regulatory Actions for PFAS in Plastic Containers
EPA published a Federal Register Notice 2024-22330 asking for public comment to inform regulations under the Toxic Substances Control Act (TSCA) on the manufacture of certain PFAS including PFOA, PFNA, and PFDA, during the fluorination of high-density polyethylene (HDPE) and other plastic containers. TSCA requires EPA to undertake risk management actions when chemicals are found to pose unreasonable risk to human health, aquatic species, and the environment. This request for public comment is being issued in response to an April 2024 petition requesting that EPA address PFOA, PFNA, and PFDA formed during the fluorination of plastic containers used for a variety of household consumer, pesticide, fuel, automotive, and other industrial products. Comments must be received on or before November 29, 2024.
