EPA to Hold Listening Sessions on PFAS CERCLA Enforcement
EPA has announced two identical upcoming listening sessions to allow the public to provide input on the Agency’s PFAS enforcement under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). The feedback received will be reviewed and considered as EPA drafts a CERCLA PFAS enforcement discretion and settlement policy related to responsible parties’ financial obligations under PFAS contamination response actions. This guidance will be aimed at addressing stakeholder concerns and reducing uncertainties regarding the Agency’s enforcement authorities and discretion under CERCLA. EPA notes that these listening sessions are separate from the Agency’s proposed hazardous substance designation for PFOA and PFOS, and any public comment during the listening sessions will not be part of the rulemaking comment docket as the comment period has closed.
There will be opportunities to provide verbal input during the listening sessions and written input submissions in a separate form. When registering for the listening session, you can choose to participate either as a participant who will give verbal remarks or as a non-speaking participant.
