EPA Posts NRDC CCR Consent Decree for Public Comment
EPA has posted a request for public comment of a proposed consent decree to address a complaint filed by the Natural Resources Defense Council (NRDC) in the United States District Court for the Southern District of New York alleging that EPA failed to perform a mandatory duty under the Safe Drinking Water Act. In January 2021, NRDC sued EPA for failure to meet the deadline to promulgate revised regulations for Consumer Confidence Reports (CCR). America’s Water Infrastructure Act of 2018 (AWIA) required EPA to issue revisions to the CCR by October 23, 2020.
According to the consent decree, EPA will publish the proposed CCR revisions by March 15, 2023 for public comment and publish the final CCR revisions by March 15, 2024. EPA is requesting public comment on the consent decree by November 26, 2021.
