EPA New Rulemaking Initiative on Effluent Limitations Guidelines for Steam Electric Power Plants
On July 26, EPA’s Assistant Administrator for Water, Radhika Fox, held a briefing call with states and signed a pre-publication Notice of Rulemaking Initiative to revise the Agency’s Steam Electric Power Generating Effluent Limitations Guidelines and Standards. EPA completed a science-based review of the 2020 Steam Electric Reconsideration Rule in accordance with President Biden’s Executive Order 13990 and is initiating a new rulemaking process to strengthen the rule with more stringent Effluent Limitations Guidelines (ELGs). EPA intends to issue a proposed rule for public comment in the fall of 2022 and will continue implementing some aspects of the 2020 rule, as well as the 2015 rule in the interim. The Agency will also consider bromide impacts to downstream drinking water intakes in the rulemaking process and plans to hold stakeholder engagements to discuss this aspect of the rule.
