EPA Adds PFAS to Toxics Release Inventory
EPA has now added 160 PFAS to the Toxics Release Inventory (TRI) as per the new requirements in Section 7321 of the National Defense Authorization Act (NDAA), passed in December 2019. EPA will revise the list of chemicals to include these PFAS under Section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA), to be effective as of January 1, 2020. Reporting forms for these chemicals will be due to EPA by July 1, 2021 for calendar year 2020 data at a reporting threshold of 100 pounds for each of the listed PFAS. The NDAA also includes provisions for EPA to add more PFAS to the TRI in the future as more information becomes available. For more information, visit EPA’s website.
ASDWA is currently working with the Association of Clean Water Administrators (ACWA) and the Environmental Council of States (ECOS) to develop joint comments in response to the EPA Federal Register Notice on adding PFAS to the TRI by the February 3rd due date, that are related to the NDAA provisions.
